Preface

This privacy statement applies to all users of the website www.tailie.nl and the mobile application Tailie (hereafter: the Tailie App).

We respect your privacy and we believe it is very important that your personal data is collected, processed, stored and protected in accordance with the applicable privacy legislation, including the General Data Protection Regulation (AVG) and the Telecommunications Act.
In this privacy statement we explain which personal data we collect, use and for what purpose. We recommend that you read this privacy statement carefully. For any questions you can contact us via info@tailie.nl.

The Tailie App is owned by DreSZcode B.V. (hereafter: we or DreSZcode). Our contact details are on page 6 of this privacy statement.
We are responsible for processing the personal data that is collected through your use of the Tailie. DreSZcode is therefore "controller" in the sense of the AVG.

This privacy statement was last changed on December 11, 2019.

Purpose of processing personal data

We need your personal data in order to be able to properly implement our service: the provision of a personal size advice for clothing.
The purpose of the Tailie service is to provide users with a clothing brand specific size advice, both online and in physical clothing stores. To use our service, we have concluded contracts with parties that operate (online) clothing stores (hereinafter: our Partners). The Tailie App generates specific data for body measurements based on the data you provide.
We use the collected data to offer, maintain, protect and improve our service and to develop new services.

Use personal data

Users must create an account to use the Tailie App. After registration, we will ask you for personal information, such as your name and e-mail address, but also your preferences for the use and settings of the Tailie. This data is stored in the registered account.

After you have registered as a user you can have yourself digitally measured in your personal account by using the Tailie App.

This digital measurement works as follows when you use the Tailie App.
We ask you to take two photos of yourself: one photo from the back of the body and one photo from the side of the body. These photos are stored (encrypted) in your personal account during the process of creating your profile.
We then ask you to place so-called "pins" in the places on the photos that we have designated: these places are called body coordinates. The Tailie App then uses an algorithm to accurately determine your body dimensions each time the service is called.
Then we ask you if you want to delete the photos from or server or if you want to store these photos for future use and have them stored in your personal account.
If you choose to not store your photos, we will delete your photos from our server.
If you choose to store the photos in your profile, the photos remain stored (encrypted) on the Tailie server in your personal profile. This allows you to adjust your profile at a later time.
Photos of unfinished profiles will be deleted 30 days after last modification.
The photos that are stored (encrypted) in your personal profile on the Tailie server can always be deleted by choosing the option “Remove stored pictures” in the app menu of the Tailie App.

After creation of your personal profile with the Tailie App is finished the following personal data of your body wil be stored in your personal Tailie profile on the Tailie server:
• Photograph of the back of the user's body (encrypted and only with user's permission)
• Photograph of the left side of the user's body (encrypted and only with user's permission)
• Coordinates of +/- 43 measuring points placed on the two photos by the user using the app

The following personal data is also stored:
• Individual device ID
• E-mail address
• Password (hashed)
• First and last name
• Body length
• Sex
• Date of birth

We also collect information regarding the use of our service when you make a purchase, such as the product number and the recommended size of the item of clothing and the date and time of the transaction. We need this information to be able to account for ourselves to our Partners in the context of our services.

Basis for processing personal data

In order to provide our users with personal customized advice, we must process personal data. We only process personal data if we have a so-called legal basis for this. Tailie processes personal data based on the following principles:
• Based on a (user) agreement: in order to be able to deliver our services and to be able to give you a personal customized advice, we need certain (personal) data from you. Think of the data needed to create a Tailie account: your name and your e-mail address.
• A legal obligation: we must retain certain financial information on the basis of tax legislation.
• A legitimate interest: we have an interest in approaching users with relevant offers and news about the Tailie App. We naturally take your privacy interest into account and we offer you the option to unsubscribe from our newsletters and offers.
• Permission: we ask for your explicit permission to process your body dimensions.

If we want to use your information for purposes other than those specified in this privacy statement, we will ask you for permission. As a user, you can always withdraw the given permission.

Storage of personal data

We store your personal data in your personal Tailie user account. This data is stored so that you do not have to enter your data every time. In addition, you can view and / or edit your data at any time in this way.
We collect and store your personal data in the DigitalOcean cloud database. We have concluded a processing agreement with this party that meets the requirements of the AVG.
We will not store your data any longer than is necessary for the purposes described in this privacy statement, unless required by law.

Third parties

We do not give our Partners access to our database of data. We are the only party that has access to the database and can determine with whom personal data is shared. For example, your personal data is only shared with the Partners who sell made-to-measure clothing and need your body measurements to adjust a piece of clothing to your measurements. With Partners who only sell ready-to-wear clothing, we only share your personal clothing size of the clothing brand (s) concerned.
We have made agreements with our Partners about the security, protection and retention periods of your personal data that meet the requirements of the AVG.
We can, however, share anonymous aggregated data with our Partners. This data cannot be traced to you as an individual. We do this, for example, to provide our Partners with specific statistical reports on body dimensions. With this general information from these statistics, Partners can - for example - evaluate the current dimensions of their garments and adapt them to new developments.

In order to be able to perform our service as well as possible, we engage other parties to process personal data on our behalf. We conclude a processing agreement with these so-called processors that meets the requirements of the GDPR. Examples of processors are: a financial service that facilitates payments in the Tailie App or an advertising agency that handles an e-mail campaign for us.

Furthermore, we only provide personal data to third parties if:
(a) we are required to do so on the basis of a legal provision or a decision of a judge or supervisory body;
(b) this is necessary in the interest of preventing, detecting or prosecuting criminal offenses (such as fraud, fraud or fraud).
We never sell personal data to third parties.

Cookies

We use information collected from cookies and other technologies, such as pixel tags, to improve the user experience and the overall quality of our services and the Tailie. For example, if you set your preferred language, we can display our services in your own language. In addition, we place cookies that collect strictly necessary information to assess the quality and effectiveness of the Tailie App. We may place such cookies without your permission.
We only place other cookies, such as cookies to show you personalized advertisements, if you have given your permission.

Security of personal data

We take the protection of personal data very seriously. We take measures to prevent abuse, loss, unauthorized access, unwanted disclosure and unauthorized alteration of personal data. The measures we take meet the general requirements of data security. We have made agreements with processors on this and regularly evaluate the measures taken and will adjust them if necessary.
In the unlikely event that a data breach ever occurs, we will carefully determine how to deal with it in accordance with applicable regulations and any obligation to inform users of the Tailie App.

Rights of users

If we process your personal data, you have the right under certain circumstances to view it, have it corrected, removed or limit it. You can also sometimes object or request the transfer of personal data.
Rights with regard to the processing of personal data: you have the right to view and change your personal data that we have collected. You have the right to object to the processing of your personal data. In certain cases, you may also ask us to limit, delete, pass on to someone else responsible for or process the processing of your personal data. This can be done by sending a request to info@tailie.nl. You will receive an overview of your personal data or a response to your request within a month of a request.

Permission: you can withdraw your consent at any time by sending an email to info@tailie.nl.

Right to make a complaint: you can submit a complaint about the processing of your personal data. If we do not meet your request for access, correction, objection, restriction, restriction, deletion or transfer of personal data, you can submit a complaint to the Dutch Data Protection Authority. If you are not satisfied with the way in which the complaint has been resolved, you can appeal to the court.

Disclaimer

This privacy statement does not apply to the websites of our Partners or business customers who are connected to the Tailie App. We are not responsible for how our Partner or business customers handle personal data. We therefore recommend that you read the privacy statements of these parties before using these websites or applications.
We are not liable for damage resulting from unauthorized access to computers or files, viruses spread through advertisements or other unlawful programs or files.

We will inform you about this. You will receive a prior notification of a change when starting the Tailie app. The privacy statement always states the last date of the change.
